  第二條 租賃期限

  2. TERM OF CONTRACT

  2.4.1乙方有如下情形之一時(shí),甲方有權(quán)提前中止合同,收回商鋪:

  a, 乙方利用該商鋪從事非法活動(dòng)或損害公共利益的;

  b, 乙方拖欠租金超過

  第三條 租金及其支付方式和其它費(fèi)用

  3. RENTAL, MODE OF PAYMENT AND OTHER CHARGES

  3.1 年租金總額:甲乙雙方商定,租賃期內(nèi)該商鋪的年租金為¥________(大寫:人民幣_(tái)____________________圓整),合同期限內(nèi)無浮動(dòng)。

  第四條 招牌設(shè)置

  4. SHOP SIGN SETTING

  甲方同意乙方在符合國(guó)家法律、法規(guī)、政府規(guī)章和規(guī)范性文件的前提下,在租賃商鋪的室內(nèi)外安裝設(shè)置帶有其公司標(biāo)志的招牌等廣告裝置(例如帶照明的透明廣告燈箱、立牌和戶外廣告招牌等),并協(xié)助乙方做好跟物業(yè)裝修申請(qǐng)、施工以及廣告設(shè)置的交涉工作。

  5.2 乙方的責(zé)任和權(quán)利

  a,合同有效期內(nèi),乙方對(duì)所租賃的商鋪及配套設(shè)施擁有合法使用權(quán);

  乙方負(fù)擔(dān);

  e, Part B have the obligation to get the authorization from Part A when install the equipments’ value over the limited of the water and electric

  meters’ value, Part B also have obligation to make the application to the related department and pay all the charges;

  e,租賃期滿或者解除合同時(shí),所屬乙方的財(cái)物,均由乙方自行處理,甲方不得以任何理由進(jìn)行任何形式的干涉;

  e, When the contract be expired or terminated, all the properties owned by Part B, Part B have the rights to handle the properties, Part A can not interfere with any reason in any modality;

  f,租賃期滿或者解除合同時(shí),由甲乙雙方共同檢查商鋪和配套設(shè)施,檢查無

  異議后,商鋪交還甲方。如發(fā)現(xiàn)有損壞的,則由乙方照價(jià)負(fù)責(zé)賠償。

  第六條 出租方和承租方的變更

  6. PARTIES CHANGE

  6.1 產(chǎn)權(quán)人與承租人:合同期內(nèi),甲方和乙方中任何一方法定代表人(或產(chǎn)權(quán)人)變更、企業(yè)遷址、合并,不影響本合同繼續(xù)履行。變更、合并后的一方即成為本合同當(dāng)然執(zhí)行人,并承擔(dān)本合同的內(nèi)容之權(quán)利和義務(wù);

  6.1 OWNER AND RENTER: During contract period, either of both parties’ legal representative(or property owner) be changed, company moved or

  6.2 轉(zhuǎn)租:合同期內(nèi),乙方如欲將租賃的商鋪轉(zhuǎn)租給第三方時(shí),必須事先征得甲方同意,并由三方書面確認(rèn),取得使用權(quán)的第三方成為本合同的當(dāng)然乙方,繼續(xù)履行本合同;

  6.2 SUBLEASE: During contract period, if Part B want sublet the shop to other parties, should consent by Part A and get the written confirm, the party who get the using rights, will be the Part B, continue perform this contract;

  6.3 甲方欲出售房屋,必須在三個(gè)月前書面通知乙方,并且要保證租賃期限的完整。

  6.3 When the Part A want sell the shop, must written inform Part B at least 3 months before, and must issue the rent period in the contract.

  第七條 違約及處理

  7. DEFAULT AND DISPOSE

  7.1 任何一方未能履行本合同規(guī)定的條款的,均視為違約;

  7.1 Either parties can not perform the rules and conditions in the contract, all deemed to be default;

  7.2若乙方違約,甲方有權(quán)提前解除合同,并無需退還已繳納的房屋租金;

  7.2.If Part B defaulted, Part A have the rights to terminate the contract and do not need pay back the paid rental;

  7.3若甲方違約,乙方有權(quán)提前解除合同,且甲方必須雙倍退還乙方已繳納但未完成使用期限的全部租金,并賠償乙方裝修費(fèi)。裝修費(fèi)賠償標(biāo)準(zhǔn):若第一年內(nèi)違約,賠償全部裝修款(100%),以實(shí)際裝修情況計(jì)算;若第二年違約。賠償裝修款的70%,以實(shí)際裝修情況計(jì)算;若第三年違約,賠償裝修款的50%,以實(shí)際裝修情況計(jì)算;

  7.4:違約方逾期向守約方賠付違約金或逾期向守約方賠償經(jīng)濟(jì)損失的,每逾期一天,守約方有權(quán)向違約方加收實(shí)欠違約金總額1%的滯納金;

  甲乙雙方本著誠實(shí)信用,互利互惠的原則,根據(jù)《中華人民共和國(guó)合同法》法律,法規(guī)的規(guī)定,就乙方租賃甲方房屋相關(guān)事宜達(dá)成本合同,以茲共同遵守:

  第一條:租賃房屋坐落地址及商鋪面積

  商鋪?zhàn)涞刂罚篲_______________________。商鋪面積約______平方米。

  第二條:租賃用途:

  商鋪使用。

  第三條:租賃期限

  1、租期五年:______年_____月_____日至______年_____月_____日。

  2、續(xù)租:本合同約定租賃期滿后,如果甲方同意乙方可以繼續(xù)承租本合同項(xiàng)下房屋,續(xù)約期內(nèi)的租金,由雙方根據(jù)當(dāng)時(shí)的市場(chǎng)價(jià)格協(xié)商確定,在同等條件下乙方有優(yōu)先權(quán),續(xù)約期內(nèi)雙方的權(quán)利義務(wù)除雙方另有約定外均適用本合同相應(yīng)規(guī)定。

  第四條:租金和支付方式及租金交納期限:

  1、租賃金額:每年___________元。

  2、付款方式:上交款。

  甲乙雙方自簽訂本合同之日,乙方一次性向甲方支付全年的房租,第二年至第五年的房租要提前一個(gè)月交。

  3、乙方必須按照約定向甲方交納租金。

  到期不交視同違約,違約金壹拾萬元整。

  第五條:房屋的附屬設(shè)施及費(fèi)用的承擔(dān)

  1、承租區(qū)域內(nèi)設(shè)施的使用乙方向甲方或第三物業(yè)管理者支付水、電費(fèi)、房產(chǎn)、土地使用稅及其他產(chǎn)生的直接費(fèi)用。

  收費(fèi)標(biāo)準(zhǔn)按北京相關(guān)標(biāo)準(zhǔn)的執(zhí)行。

  2、使用該房屋進(jìn)行商業(yè)活動(dòng)產(chǎn)生的其他各項(xiàng)費(fèi)用均由乙方繳納,(其中包括乙方自己申請(qǐng)安裝電話、寬帶、有線電視等設(shè)備的費(fèi)用)。

  3、租賃期間,由乙方導(dǎo)致租賃房屋的質(zhì)量或房屋內(nèi)外部設(shè)施損毀,包括房?jī)?nèi)外防水、門窗、水電等,維修費(fèi)由乙方負(fù)責(zé)。

  第六條:租賃期間房屋修繕

  1、出租方房屋交給承租方后,承租方在使用期間的裝修及修繕有承租方自行負(fù)責(zé)。

  如承租方不再使用出租的房屋后,承租方不得破壞已裝修固定的設(shè)施及房屋構(gòu)架。

  2、承租方裝修過程中需改變房屋原貌或改變主要結(jié)構(gòu)時(shí)得向甲方申請(qǐng),得到甲方及有關(guān)部門領(lǐng)導(dǎo)同意后方可施工,施工單位要有資質(zhì)的單位,并向有關(guān)部門備案,施工期間和施工后出現(xiàn)任何事情與甲方無關(guān)。

  如未經(jīng)同意私自施工,甲方有權(quán)提前終止合同,并賠償損失。造成后果由雙方協(xié)商或移交法律部門追究法律責(zé)任。

  第七條:甲方權(quán)利和義務(wù)

  1、有權(quán)按本合同規(guī)定向乙方收取租金及其他各項(xiàng)費(fèi)用或逾期違約金。

  2、監(jiān)督乙方正確使用房屋、并保證房屋內(nèi)外各類設(shè)施在乙方進(jìn)場(chǎng)時(shí)能正常使用。

  3、甲方不承擔(dān)乙方的經(jīng)營(yíng)風(fēng)險(xiǎn)及責(zé)任。

  4、在乙方有以下行為時(shí):擅自將房屋整修轉(zhuǎn)租、轉(zhuǎn)讓或轉(zhuǎn)借;

  利用承租房進(jìn)行違規(guī)及違章經(jīng)營(yíng)和非法活動(dòng)時(shí),損害公共利益或甲方利益時(shí);拖欠租金的行為。甲方有權(quán)提前終止合同,并提出賠償。乙方租賃期間內(nèi)可以部分面積招租或招商,甲方不得以任何理由干涉。

  5、與乙方另簽訂消防安全協(xié)議書此合同附件,監(jiān)督乙方安全使用房屋,針對(duì)發(fā)現(xiàn)乙方的安全有權(quán)要求限期整改。

  6、在乙方辦理工商、稅務(wù)等手續(xù)時(shí),甲方應(yīng)為乙方提供房屋的相關(guān)證明文件。

  7、在乙方?jīng)]有違反使用水、電時(shí),甲方應(yīng)保證商鋪正常用水用電。

  第八條:乙方權(quán)利和義務(wù)

  1、按照房屋的'使用用途,使用租賃房屋開展正常經(jīng)營(yíng)活動(dòng),不受甲方干涉,但乙方不得擅自改造用途。

  2、確保消防安全,如果因乙方使用房屋或經(jīng)乙方裝修房屋出現(xiàn)并造成人身財(cái)產(chǎn)損害時(shí),均由乙方承擔(dān)全部賠償責(zé)任。

  3、按照交納房屋租金及其他費(fèi)用。

  4、不擅自拆改房屋構(gòu)造,不在租賃房屋內(nèi)從事違法活動(dòng)。

  5、甲乙雙方在經(jīng)營(yíng)過程中如因?qū)Ψ皆蛟斐呻p方無法正常經(jīng)營(yíng),所帶來的一切損失由責(zé)任方承擔(dān)。并負(fù)責(zé)損失的賠償。

  第九條:違約責(zé)任和合同終止的賠償措施

  1、若租賃房屋因不可抗力的自然災(zāi)害導(dǎo)致?lián)p毀和造成承租人的任何損失或無法使用房屋時(shí),雙方互不承擔(dān)責(zé)任,合同終止。

  2、若甲乙雙方在沒有違反本合同的情況下提前解除合同或租給他人,視為單方違約、應(yīng)賠償對(duì)方一切經(jīng)濟(jì)損失。并有壹拾萬元的違約金。

  第十條:爭(zhēng)議的解決辦法

  本合同在履行中如發(fā)生其他爭(zhēng)議,雙方應(yīng)友好協(xié)商解決,協(xié)商不成時(shí),任何一方均可以向人民法院起訴。

  第十一條:本合同如有未盡事宜

  按《中華人民共和國(guó)合同法》的有關(guān)規(guī)定,經(jīng)甲、乙雙方共同協(xié)商,作出補(bǔ)充規(guī)定,補(bǔ)充規(guī)定與本合同具有同等效力。

  第十二條:本合同至雙方簽字蓋章后生效,本合同_____頁,一式兩份,甲乙雙方各執(zhí)一份,均有同等法律效力。
